These Terms of Service (“Terms”) govern your use of our website, chatbot automation services, and integration with WhatsApp Business API via our Facebook app (collectively, the “Services”). Use of Services
You may use our Services only for lawful business purposes in accordance with all applicable laws and regulations.
Our Services are designed to help automate customer support, lead qualification, and communication across platforms including WhatsApp, Instagram, Messenger, and website chat.
You agree not to use the Services for spam, unlawful marketing, abusive messages, or any activity that violates WhatsApp Business policies or Meta’s platform policies.
Compliance with WhatsApp and Meta Policies
You acknowledge that your use of the WhatsApp Business API via our Services is subject to WhatsApp Business Terms, Meta’s developer policies, and WhatsApp Business Messaging Policies.
You must obtain explicit user consent before sending any messages via WhatsApp or other channels through the Services.
Only approved message templates may be used for sending proactive notifications outside the 24-hour customer response window.
You are responsible for maintaining accurate records of user consents and managing opt-in/opt-out preferences.
Automated or bulk messaging that violates WhatsApp’s policies may result in suspension or termination of your access.
Intellectual Property
All trademarks, logos, and content associated with Botomation, WhatsApp, and Meta remain the respective property of their owners.
You agree to not misuse or misrepresent our Services or the WhatsApp Business API in any way.
Payment and Fees
Access to some features of the WhatsApp Business API may incur charges by Meta or related service providers.
You agree to pay any applicable fees or charges related to your use of WhatsApp Business API as passed through by us or Meta.
Fees you charge to your clients for API access must clearly disclose any charges passed from Meta and your own fees separately.
Data Privacy
Our Privacy Policy (linked here) explains how we collect, use, and protect your data and your customers’ data.
You agree to comply with all applicable data protection laws, including GDPR and CCPA, when using our Services.
Limitation of Liability and Disclaimer
We provide the Services “as is” without warranties. We do not guarantee uninterrupted or error-free operation.
We are not liable for any direct, indirect, incidental, or consequential damages arising from use of the Services.
WhatsApp Business API Services do not provide emergency or public safety communication.
Termination
We may suspend or terminate your access if you violate these Terms or WhatsApp/Meta policies.
You may terminate use of our Services at any time by discontinuing use and deleting access credentials.
Governing Law
These Terms are governed by the laws of the jurisdiction where Botomation is registered.
